Governor Gary Herbert is pressuring Utah’s legislature to consider a ban on one of the most basic needs of life in a cold environment: heat

By Scott Bradley

Utah Governor Gary Herbert is fostering the BANNING OF WOOD BURNING STOVES in Utah. He has approached Utah Legislators with a proposal that the Utah Legislature enact a law during the upcoming Utah Legislative Session (or possibly a future session if the proposal does not succeed this time) that would ban the use of wood burning stoves during the winter months in Northern Utah (from November 1 through March 15). Not surprisingly, the winter months are exactly when most people use the stoves in their homes as a primary or secondary heat source.

In addition, many people have had the foresight to install wood burning stoves in their homes as a potential source of heat in case of an emergency event that shuts off power or gas. Such an event could be precipitated by a broad spectrum of challenges — from wind damage to power lines, to snow-caused outages, to equipment failure, to energy shortages, to earthquake, to inability to pay for utility services because of personal or widespread economic difficulty, etc. It is interesting that in many large metropolitan areas throughout the United States wood burning stoves are uncommon. Sometimes, when heat is lost in these areas, people (usually the homebound old and young) suffer greatly, and some have died because of the cold in recent years.

In an area where self sufficiency is encouraged, and where natural and economic challenges could occur, it seems unwise to remove a potential safeguard of life, health, and safety.

Information that promotes the wood stove ban fosters the belief that wood burning stoves contribute as much as 5% to the periodic recurring inversions that have naturally afflicted Utah’s Northern Valleys since prehistoric times because of the topography of the land and the area’s atmospheric conditions. These pre-industrial age inversion conditions were documented in the federal government’s 1849-50 Stansbury Expedition report about the Valley of the Great Salt Lake (and Utah Valley). While this 5% “fact” is suspect, even if it were true, the banning of wood burning stoves would impact the inversions by an infinitely minuscule amount, and potentially could have an extremely dire life/safety impact if widespread need of these stoves ever became necessary.

Many believe that the proposed ban is a poorly veiled effort to appear to be a locally-driven legislative campaign to manage our air, but in reality it is likely simply an effort to curry favor with the federal Environmental Protection Agency, and keep federal dollars flowing into Utah’s Department of Environmental Quality. In other words, implementation of another federally directed program that unconstitutionally expands federal control of Utahns.

Thomas Jefferson wrote: “When all government, domestic and foreign, in little as in great things, shall be drawn to Washington as the center of all power, it will render powerless the checks provided of one government on another, and will become as venal and oppressive as the government from which we separated.” [Bergh 15:332. (1821.)]

Jefferson also wrote: “Single acts of tyranny may be ascribed to the accidental opinion of a day; but a series of oppressions, begun at a distinguished period, and pursued unalterably through every change of ministers, too plainly prove a deliberate, systematical plan of reducing us to slavery.” [Bergh 1:193 (1774.)]

Public meetings are scheduled in many counties to receive input from those in the potential ban areas. Check Utah’s Dept of Air Quality website to find when and where the meeting is to be held in your county: (http://www.deq.utah.gov/Topics/Air/woodburning/rules.htm)

CACHE COUNTY Wood Burning Stove Ban Meeting will be held JANUARY 21st 2015 AT 4:00PM at the Historic Cache County Courthouse (199 North Main, Logan, Utah — on the Southwest corner of 200 North and Main). Enter the building on the West side. PLEASE come and let your voice be heard, but if you can’t make the meeting PLEASE email your concerns about this foolish plan to: mberger@utah.gov

Regardless of whether or not your county is included in the potential ban areas, please call Governor Herbert’s office, and leave him a message (the Governor has a “comment line” upon which you can record your message). Be frank, but respectful. Please get involved. Please pass this information on!!! GOVERNOR HERBERT 801-538-1000  garyherbert@utah.gov

This is an issue of personal freedom, personal preparedness, and limiting the overreach of government into every aspect of our existence. Preserving liberty requires personal effort. LET’S KEEP THE BLESSING OF LIBERTY ALIVE FOR OURSELVES AND OUR POSTERITY ON EVERY LEVEL. Let your voice be heard. This has a deep impact on the local economy, small business, families, self-reliance and preparedness, with no evidence that this will make an impact on inversion conditions.
